Although we market ourselves as the “debt collection lawyers in Toronto and across Ontario Canada”, it would be a mistake to think you can only send a letter of demand for an unpaid loan. This article discusses several possible scenarios in which a demand letter would be appropriate.
Scenario 1 – Letters in Defence
That’s right – you need not be the potential Plaintiff to send a lawyer letter. We had one case where an employee had sent a demand letter to our client employer, making unreasonable demands and claims. Our client retained us to send a responding lawyer letter to state that he would vigorously defend against any threatened litigation. The claimant went away and never came back.
Scenario 2 – Cease and Desist
Say you have a neighbor who keeps cutting down his tree branches onto your property. You can have us send a lawyer letter demanding that your neighbor cease and desist from cutting the tree branches onto your property.
Scenario 3 – Unpaid Salary or Wages
A dismissed employee or unpaid independent contractor can have us send a lawyer letter to demand payment of salary or wages wrongfully withheld. In fact, we have a testimonial from a satisfied Toronto, Ontario creditor who had been unpaid until we sent a lawyer letter on her behalf.
Scenario 4 – Wrongful Dismissal
A wrongfully dismissed employee can have us send a demand letter to her former employer to demand payment of a reasonable severance package, vacation pay, stock options, unpaid commissions, etc.
Scenario 5 - Shareholder Disputes
You can have us send a letter of demand to your partner or 50% co-owner of a company.
Scenario 6 – Real Estate
A real estate vendor or purchaser can have us send a lawyer letter to demand specific performance under an Agreement of Purchase and Sale or to threaten a claim for anticipatory breach.
Scenario 7 – Landlord Tenant
A landlord can use a lawyer letter to threaten eviction of a tenant. A tenant can use a demand letter to threaten taking the landlord to the Landlord Tenant Board.
